Who Pays After a Granbury Car Wreck
Short answer: Texas puts the bill on the driver who caused the wreck, but that money usually comes last, at settlement. Until then, your own PIP or MedPay and your health plan carry your medical bills. If the at-fault driver has no insurance or too little, your UM/UIM can fill in.
The usual order of payment
- Your PIP (or MedPay, if you have it) pays first, whoever caused it. PIP also covers 80% of lost income (OPIC).
- Your health insurance can pick up care after that. Your plan may ask to be repaid from a settlement, which a lawyer can often negotiate.
- The at-fault driver's liability coverage pays your losses at the end, up to their limits (§601.072: $30,000 per person, $60,000 per crash, $25,000 property).
- Your UM/UIM covers what an uninsured or underinsured at-fault driver can't (§1952.101).
Why limits matter on a highway wreck
A serious crash on US 377 or SH 144 can run past $30,000 in medical bills. If the other driver carries only the minimum, that's all their insurer will pay for your injuries, which is why your own UM/UIM limits matter.
PIP stays on a Texas policy unless someone rejected it in writing (§1952.152).
