Your Vehicle Claim and Your Injury Claim
Short answer: Getting your car or truck fixed is one claim; your injuries are another. You can, and usually should, settle the vehicle first. Just be sure the paperwork you sign for the vehicle is limited to property damage.
Two clocks
The vehicle claim moves fast: an estimate, repairs or a total-loss payment, and a rental. It often wraps up in weeks. The injury claim waits until you know how you're healing: medical bills, lost wages, pain and suffering. It often takes months.
If it's totaled
The insurer pays actual cash value. If your loan is bigger than that, gap coverage, if you bought it, pays the difference.
Rentals
The at-fault driver's insurer pays for a rental, or your own rental coverage can if you have it.
Read the release
Look for the words "property damage." A broad release that mentions "all claims" or injuries is a reason to stop and ask a lawyer.
