Do You Need a Lawyer After a Granbury Wreck?
Short answer: For a fender-bender with no injuries, probably not. For a wreck where you were hurt, especially a highway crash, a disputed one, or one with an uninsured driver, a free consultation is worth it. Most injury lawyers charge nothing unless they recover money.
Signs it's time to call
- You're still in treatment, or the injuries are serious.
- The other insurer disputes fault, or the report gets it wrong.
- The other driver had no insurance or only minimum limits.
- You've been asked for a recorded statement or sent a release.
Cost and deadlines
Contingency fees mean the lawyer is paid a percentage of the recovery, with nothing upfront; ask for the percentage and how costs are handled. Most Texas injury lawsuits must be filed within 2 years (CPRC §16.003). If you're found more than 50% at fault, you recover nothing; otherwise your share reduces the award (§33.001).
About the studies that say lawyers cost you money
Those numbers mostly come from the Insurance Research Council, which is affiliated with The Institutes; its president is also chief insurance officer at the Insurance Information Institute (IRC 2025). Its data come from insurers' claim files. Here is what is in them:
- Different cases. In 2004 the IRC found represented claimants had medical expenses almost 400% higher (IRC 2004). Bigger injuries, harder cases.
- A ratio, not a total. The 2018 study put payouts at $1.17 per dollar of economic loss without a lawyer and $0.78 net with one, and represented claims took a median 375 days (IRC 2018). A larger case can have a lower ratio and still put more money in your pocket.
- Bigger gross settlements. The IRC's 1999 survey found that, and academic work linked attorneys to a 64% higher average claim (Browne & Puelz 1996; Browne & Pryor 2004; IRC 1999).
- Insurer incentives. Law professor Jay Feinman describes claim practices designed so claimants "would be deterred from hiring lawyers" (Delay, Deny, Defend).
The other side, fairly: the IRC's 2026 summary reports $1.40 with attorneys and $1.80 without per dollar of medical expense, assuming one-third fees (IRC), and a regulators' exam of Allstate's Colossus found no "systemic underpayment" (summary). None of it predicts your case.
